HOWEVER, ULTIMATE GETAWAYS AUSTRALIA CANNOT AND DOES NOT GUARANTEE THAT THE SITE OR ANY PROMOTIONAL MATERIALS IS FREE FROM ERRORS OR FAULTS. PURCHASE CONDITIONS – ULTIMATE GETAWAYS AUSTRALIA (UGA)
Please read the following purchase conditions carefully as by securing (purchasing) discount vouchers in several ways:  online at www.getawaysaustralia.com (‘Ultimate Getaways Australia’, ‘UGA’, ‘our’, ‘we’); online using our Corporate Membership Fundraising Program;through the patron/administrator of our brochure-based Fundraising Program ;or via direct contact with our office on 07 5539 8133: you (‘the customer’, ‘you’, ‘your’, ‘customers’) agree to the following terms & conditions.

THE PRODUCT
DISCOUNT VOUCHERS
A ‘Discount Voucher’, which also represents the receipt of monies by UGA, will be issued to customers upon payment of the required deposit ($69 during specified running duration of the Fundraising Program: $89 when purchasing online, or directly through the UGA office or directly through the office outside of specified Fundraising Program duration). ‘Discount Vouchers’ entitle the purchaser/s to the holiday package price promoted & valid at the time of purchase

Deposit price is subject to change and remains fixed from date of purchase.

Vouchers are valid for 12 months from the date of payment when purchased online or directly through the UGA office, and from the ‘Valid to’ date designated for the Fundraising Program when purchased through the Fundraising Program patron/administrator

Vouchers comprise the following information:

1. Customer Booking Name
2. Resort Name
3. Package Specifications (number of persons & duration of accommodation authorized & validated by purchase & presentation of voucher upon checking-in)
4. Expiry Date for use of the holiday package only at the price valid at time of purchase (all aspects of the resorts operation and inventory including surcharges, availability, resort facilities & services are subject to change without notice and may be applicable as is the prerogative of the resort management).
5. A 4-digit receipt/security number preceded by a letter (i.e. W, O, BW) corresponding to that issued upon purchase & maintained as identifiable with the customer’s personal information stored in our Client Database.
6. The resort contact telephone number
7. The Ultimate Getaways Australia ‘island’ logo & company contact details.
8. The following ‘Conditions of use’: The deposit that comes off the total package price of the holiday you have chosen. When you are ready to book your holiday, complying with the special conditions of your resort, all you do is ring the appropriate booking number to make your reservation, quote your certificate number and it is at the same time that the balance is payable. When you are going on holidays, you must present this receipt upon check in. If you wish to take up several of these packages, you will require a certificate for each property. Not to be used in conjunction with any other offer. Note: Fully inclusive of GST. Deposits are non-refundable. Accommodation is always subject to availability. Deposits are non- refundable’.

HOW TO PURCHASE DISCOUNT VOUCHERS
Quotes & voucher purchase are subject to availability and actual pricing at time of purchase.

Purchases can be made in 3 ways:

1. Online at www.getawaysaustralia.com by inserting your holiday package selection and contact & payment (credit card) details in the ‘Buy Vouchers’ form
2. By calling our office direct on + 07 5539 8133.
3. By purchasing a receipt/voucher through a representative/patron of our ‘Fundraising Program’ as conducted through selected social clubs, businesses, companies and fundraising organizations. 

Deposit –Discount Voucher Purchase
A non-refundable deposit of $69 (when purchasing through the Fundraising Program) or $99 (when purchasing through the UGA website or office direct) must be received by UGA before vouchers are issued and security codes (voucher/receipt numbers) are activated. Payment of this deposit represents the customer’s acceptance of the UGA purchase conditions. 

Ultimate Getaways Australia bears no responsibility for monies paid to Fundraising Program administrators, sent via mail (cash, cheque, money order) or credit details provided until cleared funds are accepted into UGA trading accounts.

Customer detail processing & validation of Discount Vouchers will not commence until such time as this acceptance occurs.

 
Final Payment – Discount Holiday Package
The deposit paid (voucher purchase price) is deducted from the total price of the purchased holiday package.

Balance is payable on booking to the specified resort subject to the terms & conditions of the resort itself. The resort reserves the right to specify payment options & conditions, including & not limited to, holding deposit, partial payments, bonds or credit card details.

 
Payment Options – Discount Voucher Purchase
Payment methods accepted include credit cards (Visa, Mastercard & Bankcard only), personal & bank cheques and money orders. Package prices quoted are in AUD.

Package Prices & Changes
All prices featured are valid from 12th July, 2004. Prices and conditions are current but are subject to change without notice. Prices listed are in Australian Dollars and are inclusive of GST where applicable, do not include transport from your home to holiday destination or return, personal items, meals or meal credits (unless specified), transfers or any existing or proposed government taxes and charges.

Any verbal quote given is an estimate only of price based upon the chosen package and any additional accommodation requirements, however only the deposit paid / voucher purchase and existing package specifications and price remain fixed for 12 months from the date of purchase. Package prices can not be guaranteed until point of purchase and dates confirmed or quoted can not be guaranteed until the customer has booked directly with the resort, at which time the responsibility for upholding this remains the resort management’s.

Not included in price of package
Flights, transport of any description, transfers, travel services, car-hire, meal vouchers (unless specified), child minding (unless specified), activities (unless specified), insurance of any description, medical cover, local, state or federal government taxes (except GST which is included), costs of a personal nature (laundry, taxis, hygiene).

Bookings
Ultimate Getaways Australia is a marketing company contracted to market specific packages for resorts. The packages found within UGA’s website & promotional materials are fixed in duration, number of persons accommodated and price. Ultimate Getaways Australia extends the services of checking availability at the time of initial customer enquiry & also providing price estimates based upon core package & special requirements (i.e. extra person, extra night) pricing available, however these services are not binding quotes and are subject to change without notice.

UGA does not make bookings on behalf of the customer: we provide the discount voucher, 12-month validity from date of purchase and resort contact details for customers to make their own booking directly with the resort.

After the sale/purchase transaction has been finalised, signified by the issue of the discount voucher & simultaneous acceptance (by the customer) of the purchase terms & conditions, the booking and accommodation responsibility is beared by the customer & resort respectively.

UGA sells resort accommodation packages from an inventory supplied by each resort, and does not oversell that inventory. UGA does not accept any liability for unavailability of rooms caused by the resort overselling the resorts own room inventory.

To the best of UGA’s capability the number of persons accommodated by individual packages complies with laws, regulations, standards and guidelines imposed by the Queensland Government, Building Codes Qld and the Queensland Fire & Rescue Service for accommodation housings. These pertain to occupancy in terms of floor areas, building types, fittings & fixtures and UGA will not bear responsibility for the non-compliance to these standards by the resorts UGA markets. The discounted vouchers UGA sells to enable the sale, by resorts, of specified accommodation packages is done so with faith in the honesty of customers as to number of persons utilizing a single package. The resort manager maintains the right to accept or refuse the use of a discount voucher based upon the discretion of management & the resort’s own interpretation and/or compliance to any law, regulation, guideline, code or terms & conditions.

Purchase & Bookings
The person purchasing a discount voucher is deemed to have accepted the UGA purchase and booking terms & conditions on behalf of all persons utilizing the accommodation package entitled by the purchase and booked of the customer’s own accord.

Cancellation
Deposits/Voucher purchases are non-refundable with the exception of extenuating circumstances approved by UGA management. Every effort is made to provide an alternative in the case of a cancellation request, with 2 options available:

1. Transfer of discount voucher to a different resort. Internet purchases may transfer to any resort listed on the UGA website. Written correspondence & postal charges apply. Purchases made through the Fundraising Program entitle the customer to transfer to another of the resorts present on the flyer from which the original resort selection was made. Correspondence and postal charges may be incurred by the customer. Additional charges apply to transfer to a resort not present on the flyer from which the original selection was made.
2. Extension of discount voucher expiry date. Written correspondence is required and the extension must be approved by the resort management and be negotiated directly between the customer and the resort management.

Complaints
Complaints must be received in writing to be deemed valid.

Personal Injury and Loss disclaimer
Ultimate Getaways Australia markets properties on behalf of the property owners and management as a marketing company and shall not be liable under any circumstances for any failure by the property owner and management to fulfil any requirement of customers booking with the resort using an Ultimate Getaways Australia discount voucher.

Ultimate Getaways Australia will not be liable for any accident, injury, delay, property damage or personal loss to you or those travelling with you in connection with any accommodation, transportation or other travel services resulting directly or indirectly from any occurrences or conditions beyond its control, including but not limited to acts of terrorism, acts of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.

Resorts
Every effort is made by Ultimate Getaways Australia to ensure that the description of facilities and services of the resorts that UGA markets and sells discount vouchers to is accurate, however these are continually being changed, upgraded or being taken out of service therefore UGA can not be held liable for omissions or errors both temporary and permanent of a property’s facilities or services.

Every effort is made to ensure that the resort photos featured on the Ultimate Getaways Australia website and promotional materials are current however room photos may not be specific to actual room allocated and resort complex images are subject to changes, upgrades and removal without notice.

Ultimate Getaways Australia is committed to protecting the privacy and security of any personal information provided to us. This privacy pledge relates to any information that can be identified with a specific individual such as name, postal address, phone number, fax number, email address and credit card information.

This statement is consistent with the commonly accepted principles of privacy. This statement was last updated on the 15th July, 2004.

What Information we collect
 
In order to maintain the high quality service provided by Ultimate Getaways Australia, we collect personal information from you: your name, postal address & telephone number and email address.

This information is stored in our ‘Client Database’ along with the date of voucher purchase, resort selection and voucher number/s for approximately 12 months (the duration of the discount voucher validity).

When you Purchase a Voucher
When the customer purchases a voucher we need personal contact information to ensure a secure purchase process for both the customer and Ultimate Getaways Australia. Your full name, postal address, phone number and credit card details are among the details we require for our database. You may choose not to provide the details we request; however we are unable to process or validate your booking without these details.

When you make a Telephone Inquiry
When a customer phones the UGA office directly seeking information or services such as a staff member checking availability at resorts on behalf of the customer, the customer name and contact telephone number will be written as a paper document. This information is destroyed at the point of booking after being converted to an electronic record in the database or at such time that the staff member has satisfied the customer query& no further correspondence is deemed necessary.

When you Contact getawaysaustralia.com
Ultimate Getaways Australia collects personal information such as your full name, email address and/or telephone number whenever you submit a query or suggestion, or request assistance or information relating to the products and services we provide.

When you Subscribe to our Newsletter
Ultimate Getaways Australia collects email addresses from people who subscribe to the UGA newsletter by entering their email address in the “Newsletter” option box featured on the website. You can choose to unsubscribe by selecting the ‘unsubscribe’ option on newsletters, via a ‘contact us’ request form, by direct email to getaways@getawaysaustralia.com or by verbal request to our office directly on + 61 7 5539 8133.

When you Buy Vouchers at www.getawaysaustralia.com
The ‘Buy Vouchers’ form requires the customer to enter personal information consisting of the customer’s name, address, phone number, email address along with selecting the payment option they wish to use:

1. Credit Card Purchases an Ultimate Getaways Staff Member will call to confirm your details.
2. Cheques / Money Order purchases will be processed upon receiving payment.

Who we may share your information with

• Legal parties & Courts of Law in accordance with local, state and federal laws.
